Jay was sentenced to 25 years in the Pen, with 5 years suspended. Meaning he will be up for parol in about 17 years. He did get credit for time served. Which was approx 375 days. He must serve at least 85% of his sentence. Although it doesnt seem like much, he could have easily gotten less had it went to a jury trial based on the whole mental illness act he was playing. Keep in mind the mental illness act was used when it worked for them, and not used when it didnt matter. It was a very emotional, intense trial but we are happy it is over. There is a no contact order in place for our family as well. As far as the custody end of things, we are still trying to obtain custody of the youngest boy Jaycob. Thankfully when Jay is transfered to Bismarck pen it will make it harder for Kitty Dill (Jays mother) to take Jaycob to see him. He shouldnt be seeing him anyways! But thats my opionion. Another slap in the face. But anyways, its all over now! We have a new battle starting! Thanks for all the support we have recieved!

I firmly prayer he will get the maximum allowed sentence and if not he will still have to prove himself a model prisoner for any hopes of early release and i really don't see him pullin that one off with any ease. Give Hayden huge hugs and some Jaycob when you see him too. Please drop me a line to let me know how the hearing went and if you ever need character statments from me i am there for ya. Beth: To answer your question about visitation, there is nothing set in stone by any court, we do get to see our grandson occasionally but only if we ask permission from Jays family to see him. That is how a temporary custody order works. In other words we have to ask the permission of the mans family that murdered our daughter to see our own grandson. I ask you, do you think that is a fair option for us.
As far as him pleading guilty, yes he did change his plea to guilty but that was an agreement between his attorney and the states attorney. So in essence, he may get a sentence of a mere 25 years or possibly less. So yes he may see the light of day again.

Beth: Jay's son is with Jay's family. Only because they saw to it to give themselves an adge in the custody issue by gaining temporary guardianship a mere two days before the funeral without even discussing it with us. And to top it all off WE get a letter from a court judge in Minot telling us that we are overreacting to the situation. Now, I ask any person with any common sense, How would you expect this family to react? We have adopted Jens oldest son and have fought tirelessly to keep these two children together. Jay's family on the other hand have worked just as tirelessly at just the opposite and have so far succeeded in their efforts. Jay also has other children that he nor his family have had any interest in having custody of. That brings up the question of why this child? Why now? Why after all that has happened would they opt to continue to torture the family of the person your family member murdered? I wish that I had that answer?
The sad thing about this custody issue is that status and money are doing the talking here and that is a sad testament to our society today.
As far as justice, NO, there will be no justice served here, there may be punishment but there will never be justice! Justice is only a word that we use to proclaim that you HAVE violated one of the Ten Commandments of a Christian Society and true justice will be served on Jay on his judgement day. Reply...

Don, as I said I will be out of state during the time of the hearing but know that some mighty prayers will be said for Jen to receive an early Earthday gift the gift of justice. My daughter and I wrote a poem for my Grandmother,Anna, quite some time ago, I'd like to repeat that here.

Jessica, talked to your Mom the other night and it tears me up to hear what you and yours are going through and being able to do nothing. I am a good listener and one of the stauchest supporters of your folks,you and your family, and Rach and hers, and most of all of Jen her boys. Please feel free to contact me at any time for whatever reason and keep me apprised of "The Rats" defense game as I have come to believe that that is exactly what he is playing wiht not only the lawyers in this horrific case but also the mental health system that is diagnosing him. The scary thing is that according to the suppression hearing he seems to be pulling it off. I pray every day for all of Jen's beautiful family to be together once again. And hopefully soon!!!!!! Thanks Ruth :) I know you were a very good friend to Jen :) Your right, we arent fighting for what we want, we are fighting for what Jen wanted!!! Her boys to be happy and taken care of, and to have a "normal" life together. Thats what she wanted more than anything else. She screwed a few things up in life, but who doesnt and she knew when she messed up and she ALWAYS tried to make it right. So many people loved her. and so many people still love her. jennifer was one of my closest friends since grade school...words cannot describe her...funny, sweet, dorky... she was so awsome...she would never hurt anyone and was all about living life to the fullest...of course she wasent perfect-but who is?? no one deserves to be murdered the way she was...jennifer was a mother, daughter, sister, aunt, friend...all taken away by one person...and now the focus has become jays rights...well what about jen's?? just because she is not here dosent mean she should be forgotten...but thats how it seems to be going...when you read this think of someone close to you-now what would you do if someone did this to them? of course her family is trying to get some action in their favor...they are not fighting for them selves...they are fighting for jenn...shes not here to fight for her self or her children so someone has to...
